Terms of Service

1. Acceptance of Terms

By accessing or using the Senayah platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. Senayah reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

2. Description of Service

Senayah is an online platform that connects individuals seeking mental health services ("Clients") with licensed mental health practitioners ("Practitioners"). The Platform provides scheduling, secure video sessions, messaging, payment processing, and related tools. Senayah is not a healthcare provider and does not provide therapy, counselling, or medical advice.

3. Eligibility

You must be at least 18 years of age to use the Platform. By registering, you represent that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding agreement.
  • All information you provide is accurate, current, and complete.

4. User Accounts

4.1 Registration

You must register for an account to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4.2 Account Types

The Platform supports Client accounts and Practitioner accounts. Practitioner accounts require approval by Senayah before activation. Practitioners must provide valid professional credentials and licensing information.

4.3 Account Termination

You may delete your account at any time through your account settings. Senayah may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users.

5. Practitioner Responsibilities

Practitioners using the Platform agree to:

  • Maintain valid and current professional licenses in their jurisdiction.
  • Provide services in accordance with applicable professional standards and ethics codes.
  • Maintain appropriate professional liability insurance.
  • Comply with all applicable privacy legislation including PIPEDA and PHIPA.
  • Not provide services outside their scope of practice.
  • Maintain the confidentiality of client information.

6. Client Responsibilities

Clients using the Platform agree to:

  • Provide accurate personal and health information.
  • Attend scheduled sessions or cancel within the required notice period.
  • Understand that online therapy has limitations and is not a substitute for emergency services.
  • Contact emergency services (911) if they are in immediate danger or experiencing a mental health crisis.
  • Maintain a private and secure environment during video sessions.

7. Payments and Fees

7.1 Session Fees

Session fees are set by individual Practitioners and displayed on their profiles. Clients are charged after a session is marked as complete by the Practitioner via the payment method on file.

7.2 Cancellation Policy

Clients may cancel or reschedule appointments free of charge up to 24 hours before the scheduled session time. Cancellations within 24 hours may be subject to a cancellation fee of up to 50% of the session rate. No-show appointments may be charged the full session rate at the Practitioner's discretion.

7.3 Platform Fees

Senayah charges Practitioners a platform fee for use of the service. This fee is deducted from Practitioner payouts and does not affect the price Clients pay.

8. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. Senayah takes the security of your personal and health information seriously and complies with applicable Canadian privacy legislation including PIPEDA.

9. Video Sessions

Video sessions are conducted through secure, encrypted third-party video infrastructure. Senayah does not record video sessions. Users are responsible for ensuring they have a stable internet connection and a private environment for sessions.

10. Messaging

The Platform provides secure messaging between Clients and Practitioners. Messages are not a substitute for emergency communication. Practitioners are not obligated to respond to messages outside of scheduled sessions.

11. Intellectual Property

All content, design, and technology of the Platform are owned by Senayah and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from Platform content without express written permission.

12. Limitation of Liability

Senayah provides the Platform on an "as is" basis. To the maximum extent permitted by law:

  • Senayah is not responsible for the quality of services provided by Practitioners.
  • Senayah is not liable for any damages arising from use of the Platform.
  • Senayah does not guarantee uninterrupted or error-free service.
  • The therapeutic relationship exists solely between the Client and Practitioner.

13. Dispute Resolution

Any disputes arising from these Terms or use of the Platform shall be governed by the laws of the Province of Ontario, Canada. The parties agree to attempt resolution through good-faith negotiation before pursuing legal action.

14. Emergency Disclaimer

Senayah is not an emergency service. If you are in crisis or experiencing a medical emergency, call 911 or go to your nearest emergency room. You may also contact the 988 Suicide and Crisis Lifeline by calling or texting 988.
